These Terms form an agreement between you and 上海安吖吖数字科技有限公司, a company established in China and the operator of DesignSmith ("DesignSmith," "we," "us," or "our"). By creating an account, accessing the service, or purchasing a subscription, you agree to these Terms.
1. The service
DesignSmith is an AI-assisted software-as-a-service platform for game designers and studios. It helps users turn source material and early ideas into structured game-design documents, reviews, revisions, and handoff materials. DesignSmith supports design and planning work; it does not perform formal game development, produce final production assets, or replace professional judgment.
2. Eligibility and accounts
- You must have the legal capacity to enter into a binding contract in your country or region. The service is not directed to children.
- You must provide accurate account information and keep access to your email account secure. You are responsible for activity performed through your account unless caused by our breach.
- You may not share, sell, or transfer an account in a way that circumvents plan limits or creates security risk.
- Tell us promptly at shuitunsiyangyuan@anyaya.cn if you believe your account has been compromised.
3. User content and AI processing
You retain ownership of the ideas, files, text, project data, feedback, and other material you submit ("User Content"). You grant us a limited, non-exclusive right to host, copy, transmit, process, and transform User Content only as needed to operate, secure, support, and improve the service.
You confirm that you have the rights and permissions needed to submit User Content. You must not submit unlawful content, confidential material you are not authorized to process, malicious code, or content that infringes intellectual property, privacy, publicity, or other rights.
To provide AI features, relevant User Content and instructions may be transmitted to third-party model providers. AI output can be incomplete, inaccurate, similar to output generated for others, or unsuitable for production. You are responsible for reviewing, editing, testing, and validating output before relying on or publishing it. DesignSmith does not provide legal, financial, safety-critical, or other professional advice.
4. Acceptable use
You may not use DesignSmith to:
- violate any applicable law, regulation, sanction, or third-party right;
- generate, distribute, or facilitate malware, fraud, harassment, exploitation, or other harmful activity;
- probe, disrupt, overload, bypass, or gain unauthorized access to the service or another user's data;
- reverse engineer or systematically extract the service, prompts, models, or content except where applicable law expressly permits it;
- resell access, operate an unauthorized competing service, or evade usage, account, or payment controls;
- use the service or Paddle Checkout for anything prohibited by Paddle's acceptable-use rules.
5. Subscriptions, trials, and billing
DesignSmith offers Starter, Pro, and Advanced subscriptions with monthly and annual billing. Current features and localized prices are shown on the Pricing page. Starter may include a 7-day free trial as displayed at checkout.
Paid transactions are processed by Paddle, which acts as the authorized reseller or merchant of record where applicable. Paddle collects payment information, applicable taxes, and billing details and provides receipts. By starting a paid subscription, you authorize Paddle to charge the displayed recurring amount until cancellation.
Subscriptions renew automatically for the same billing interval unless canceled. You may manage or cancel through the Paddle-hosted customer portal, a link in your Paddle receipt, or Paddle buyer support. Cancellation normally takes effect at the end of the current paid period unless Paddle or applicable law states otherwise. Refunds are governed by our Refund Policy, Paddle's terms, and mandatory law.
6. Service changes and availability
We may update features, models, usage limits, interfaces, and plan contents to maintain or improve the service. We may also suspend service for maintenance, security, legal, or operational reasons. We do not guarantee uninterrupted or error-free availability. If a material paid feature is discontinued, we will provide notice or an appropriate remedy where reasonably possible or legally required.
7. Our intellectual property
DesignSmith and its software, interfaces, workflow, documentation, branding, and related materials are owned by or licensed to us and are protected by applicable intellectual-property laws. Subject to these Terms and an active account, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for your own personal or business game-design work. No other rights are granted.
8. Suspension and termination
You may stop using the service at any time and may cancel a subscription as described above. We may restrict or terminate access if you materially breach these Terms, create a security or legal risk, fail to pay, engage in fraud or abuse, or if required by Paddle, a payment partner, or law. Where appropriate, we will provide notice and a reasonable opportunity to remedy the issue.
Upon termination, your right to use the service ends. Provisions that by their nature should survive—including payment obligations, intellectual property, disclaimers, liability limits, and dispute terms—will continue to apply.
9. Disclaimers
To the maximum extent permitted by law, DesignSmith is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. These exclusions do not affect warranties or consumer rights that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data, arising from the service. Our aggregate liability arising from DesignSmith will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, willful misconduct, death or personal injury caused by negligence where applicable, or non-waivable consumer rights.
11. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles. Subject to any mandatory consumer law or jurisdiction that applies to you, disputes will be submitted to a competent court where the operator is registered. Before filing a claim, please contact us so we can try to resolve the issue informally.
12. Changes to these Terms
We may update these Terms to reflect product, legal, security, or operational changes. We will post the updated version and change the effective date. If a change materially affects your rights, we will provide additional notice where reasonably possible or required by law. Continued use after the effective date means you accept the updated Terms.
